LICENSE
RadSCRIPTS.com, (a division of 9o9o.com Inc.), grants you an exclusive license to use its RadLANCE software if you agree to follow all restrictions in all sections of this Agreement.
Important: RadLANCE software is NOT an open source software product. You must agree to follow the limitations in this software agreement. RadLANCE is a copyrighted work of authorship and is also protected under applicable database laws. RadSCRIPTS.com retains complete ownership of this software and any copies of it, regardless of the form in which the copies may exist. This license is not a sale of the original software, or any copies of same, but is an authorization to "use" said software.
By installing and using RadLANCE on your server, you agree to the following terms and conditions. Such agreement is either on your own behalf or on behalf of any corporate entity which employs you or one which you represent ('Corporate Licensee'). In this Agreement, 'you' includes both the reader and any Corporate Licensee:
Although all copyrights visible to users via browser are not required, the Powered By: RadLANCE link back to RadSCRIPTS.com must remain in tact and in place unless one has purchased an "unbranded" license. All RadLANCE and RadSCRIPT copyright notices contained in both the branded and unbranded software source code files and the Administrative panel must remain unchanged, visible and in tact. Copyright notices, license numbers and keys contained therein must not be removed or altered under any circumstances. Adding or altering an existing "Powered By: RadLance" link back or copyright is in direct contravention of this license agreement. Said alteration will terminate all support services, the availability of all updates, potential upgrades shall cease forthwith. You also agree to uninstall the software and destroy any copies in any form.
1) RadSCRIPTS grants you the right to install and run one instance (a single installation) of RadLANCE per domain name for each license purchased. For each installed instance of our software, a separate license is required. Modifications to the software or database to circumvent this rule are prohibited.
2) RadLANCE is licensed only to one owner of a domain name and is key locked to said domain. You may not rent, lease, sub-license, sell, assign, pledge, transfer or otherwise dispose of RadLANCE in any form, on a temporary or permanent basis without the prior written consent of RadSCRIPTS.com.
3) All customers must include the URL to where RadLANCE will be used when ordering.
4) At the owners risk, anyone may alter software, produced by RadSCRIPTS.com , but said software, altered or otherwise, may not be distributed to entities beyond the license holder. Third party modifications are at the risk of the owner/user and will not be supported by RadSCRIPTS.com

| SCOPE OF GRANT |
| You undertake to: |
- ensure that prior to the use of RadLANCE by your employees or agents, all such parties are notified of the terms of this Agreement; and
- hold all data (including object and source codes), software listings and all other information relating RadLANCE confidential and not at any time, during the period of the license or after its expiry, disclose the same whether directly or indirectly to any third party without RadSCRIPTS consent.
- not to use the RadLANCE for any illegal purposes and shall comply with all applicable legislation.

| You may not: |
- permit other individuals to use test or modify RadLANCE except under the terms outlined in this license agreement
- reverse engineer, disassemble, or create derivative works based on RadLANCE for distribution or usage outside your web site.
- use RadLANCE in such as way as to condone or encourage terrorism, promote or provide pirated software, or any other form of illegal or damaging activity.
- distribute RadLANCE.
- distribute or modify proprietary code graphics, HTML, or CSS packaged with RadLANCE for use in other software applications or web sites without written permission from RadSCRIPTS.com.
5) Registered users may modify RadLANCE code for their personal use, at their own risk. Any altered code must not be redistributed or resold in any form.
6) RadSCRIPTS software may not be used for anything that would represent or is associated with an Intellectual Property Violation, including, but not limited to, engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities.
7) If any terms are violated, RadSCRIPTS.com reserves the right to revoke (terminate) licenses at any time. No license refunds will be granted for revoked (terminated) licenses. RadSCRIPTS.com reserves the right to modify these terms at any time. This license is governed by the International Copyright Laws.
8) Once you are in receipt of our software, License fees are non-refundable. We encourage you to verify that the server which hosts your web site supports the latest stable versions of MySQL and PHP before purchasing software from RadSCRIPTS.com. For complete system requirements, please visit the requirements page that accompanies each program/script. In the event that RadSCRIPTS.com determines that a refund is warranted, said refund will be subject to a 25% surcharge in order to cover all installation services and fees charged by credit card retailers.
9) RadSCRIPTS reserves the right to advertise all legal license holders on our site whether they own a branded or unbranded license. Illegal license holders will be publicly exposed on SoftwarePirates.net.
THE LAW
Your acquisition and use of RadLANCE is governed by international copyright laws and the license agreement accompanying the software. Therefore, you should be aware that it is a breach of the license agreement and it is illegal: |
(i) To copy or distribute software or its accompanying documentation, including programs, applications, data, codes, and manuals, without permission or a license from the copyright owner;
(ii) To run a copyrighted version of RadLANCE on two or more computers simultaneously unless this is specifically allowed by the license agreement;
(iii) For organizations to consciously or unconsciously encourage, allow, compel, or pressure employees to make or distribute unauthorized software copies;
(iv) To infringe the laws against unauthorized software copying because someone requests or compels it;
(v) To lend software so that a copy can be made or to copy software while it is lent to you;
(vi) To make, import, possess, or deal with articles intended to facilitate the removal of any technical means applied to protect the software program. |
Disclaimer of Warranty
RadSCRIPTS.com REPRESENTS AND WARRANTS THAT RadLANCE |
(i) LICENSES AS SUPPLIED AND INSTALLED DO NOT CONTAIN ANY VIRUS, TROJANS, WORMS OR MALWARE; AND
(ii) IN COMPLIANCE WITH SERVER REQUIREMENTS, WILL PERFORM IN ACCORDANCE TO ITS DOCUMENTATION AND INFORMATION AS SPECIFIED ON RadSCRIPTS.COM.
OTHER THAN WARRANTIES EXPRESSED, THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD ON AN "AS IS" BASIS , WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OTHER THAN THOSE EXPRESSED AND NOT IMPLIED.
RadSCRIPTS.com IS NOT LIABLE FOR ADDITIONAL CONTENT ADDED TO RadSCRIPTS PRODUCTS OTHER THAN THAT WHICH IS PROVIDED BY RadSCRIPTS.COM. |
PROPRIETARY LABELS
Authorization to remove the Powered by: RadLANCE link back is allowed for specified fees. These fees authorize you to remove the output of the Powered By: RadLANCE, but it does not give you authorization to remove any copyright notices in the script source files nor any other rights. Said Removal is to be conducted by RadSCRIPTS.com
What are the penalties for pirating software?
If caught with pirated software, the infringing company or individual may be liable under both civil and criminal law. A civil action may be instituted for injunctive relief, actual damages (including infringement profits), or statutory damages up to $20,000 per infringement. Criminal penalties for copyright infringement include fines up to $1,000,000 and jail terms up to five years, or both.
TITLE
Title, ownership rights, and intellectual property rights in the Software shall remain with RadSCRIPTS.com. The Software is protected by copyright laws and treaties. Title and related rights in the content accessed through the Software is the property of the applicable content owner and may be protected by applicable law. This License gives you no rights to such content.
TERMINATION
This Agreement will terminate automatically if you fail to comply with the limitations described herein. On termination, you must destroy all copies of the Software immediately.
Encrypted Code
In an effort to combat piracy and for the protection of proprietary code contained in the RadLANCE Admin panel, installation of software is now key locked and certain areas of RadLance contain encrypted code. In an effort to protect your investment and ours, said code will not affect any modifications or design integrations that you may wish to conduct. Note: Removal of encrypted code will cause your script to malfunction.
FREE SUPPORT and FUTURE UPDATES will be offered only to those that abide by the conditions stated herein. Technical support will not be provided for third-party modifications and will be subject to additional fees.
MISCELLANEOUS
RadSCRIPTS.com reserves the right to refuse and or reject sales orders.
RadSCRIPTS.com reserves the right to change price of its software without notice, bonus or refund.
RadSCRIPTS.com reserves the right to publish a selected list of our software users.
RadSCRIPTS.com reserves the right to change the terms of this Agreement at any time.
